Morrison Developments has withdrawn its application for a judicial review of THIs consent for a leisure scheme at Cheshire Oaks.
THI has outline planning consent for a 16,072 sq m (172,000 sq ft) scheme – comprising a 14-screen multiplex and a 3D cinema – on Church Commissioners land adjacent to the Cheshire Oaks factory outlet centre.
Morrison was objecting to Ellesmere Port Councils decision to grant consent for change of use from retail to leisure for THIs scheme. By contrast, Morrison’s own proposals for a town centre scheme are expected to be called in by the Environment Secretary.
THIs managing director John Henley said: “We have not defeated judicial review applications against THI at Sheffield and Cheshire Oaks and THI will continue to treat any similar actions very seriously.” However, THI is now seeking order of costs, which it expects to be substantial.
